Terms of Service.

These Terms of Service (“Terms”) govern your access to and use of the websites, products, directories and mobile applications operated by The Signature Cheese Pty Ltd (ABN 36 689 421 314) (“we”, “us”, “our”) (together, the “Services”). By accessing or using the Services, you agree to these Terms. If you do not agree, please do not use the Services.

Eligibility

You must be at least 16 years old, or the age of majority in your jurisdiction, to use the Services. By using them, you confirm that you meet this requirement and that any information you provide is accurate.

Acceptable use

Your use of the Services must comply with our Acceptable Use Policy. In short, you agree not to misuse the Services, interfere with their operation, or use them for any unlawful purpose.

Intellectual property

The Services, including their design, text, graphics, logos and software, are owned by or licensed to The Signature Cheese Pty Ltd and are protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable licence to access and use the Services for their intended purpose. You may not copy, reproduce, scrape, republish or create derivative works from the Services without our prior written permission, except as permitted by law.

Directory listings & third-party content

Many of our products are directories that display information about third-party businesses and link to external websites. We do not control, endorse or guarantee third-party businesses or content, and inclusion of a listing is not a recommendation. While we take reasonable care, we do not warrant that listing information is complete, accurate or current. Your dealings with any third party are solely between you and that third party.

Apps

Where you download one of our apps from a platform such as the Apple App Store, your use is also subject to that platform’s terms. The relevant platform is not responsible for the app or its support.

Disclaimers

To the maximum extent permitted by law, the Services are provided “as is” and “as available”, without warranties of any kind, whether express or implied. We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components.

Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred on you by the Competition and Consumer Act 2010 (Cth) (including the Australian Consumer Law) or any other law that cannot lawfully be excluded. Where our liability for breach of such a guarantee can be limited, our liability is limited, at our option, to re-supplying the relevant services or paying the cost of having them re-supplied.

Limitation of liability

Subject to the section above, to the maximum extent permitted by law, we will not be liable for any indirect, incidental, special or consequential loss, or any loss of profits, revenue, data or goodwill, arising out of or in connection with your use of the Services.

Indemnity

You agree to indemnify us against any claims, losses or costs arising from your breach of these Terms or your misuse of the Services, except to the extent caused by us.

Termination

We may suspend or withdraw all or part of the Services, or your access to them, at any time where reasonably necessary — including for maintenance, security, or breach of these Terms.

Governing law

These Terms are governed by the laws of Victoria, Australia, and you submit to the non-exclusive jurisdiction of the courts of that State.

Changes to these Terms

We may update these Terms from time to time. Changes take effect when we post the updated Terms and revise the “Last updated” date above. Your continued use of the Services after that constitutes acceptance of the changes.
